A sister’s courtroom perspective and other thoughts

April 11, 2007 marks the beginning of this madness and the tragic end of my sister’s life. It has been a long battle to get to this courtroom. It seems inconceivable that the days have finally arrived, yet years overdue.

It has been very difficult for me to listen to a description of Michele’s final days.  I found myself having to go somewhere else in my mind to withstand the aching inside as the tragic details are unraveled.  I would hear the proceedings, but would have to, at times, take my mind back to our innocent childhood days as sisters.   I would reflect back upon some good memories I could recall like playing with our dog Daisy’s puppies, pulling wagons, riding bikes, piling on the couch with mom to watch our favorite tv shows, sucking big fresh dill pickles from the grocery store deli for a dime, getting ready for school together and so many other special times. Martin’s 1977 Fraud Charges & Falsified School Transcipt-A story of inspiration

Michele Meeting Martin:
In 1977 our family moved from Concord, California to Mission Viejo, California.  It was in Mission Viejo in late 1977 where Michele met Martin and they began dating.  We learned during their time dating that Martin was in some trouble for writing bad checks.  Their courtship was extremely short.  We soon discovered much to our family’s disapproval of Martin, they had eloped.

It wasn’t until after they were married that Michele and our family learned the true seriousness of the crimes he was charged with.  We soon discovered he was charged with 14 felony counts of fraud.  These crimes had been committed about a year before even knowing my sister.  This was upsetting to all of us that he was not upfront,  but more importantly he had deceived Michele.  He made light of it when he was dating her by telling her he had made a dumb mistake in the past and had written a few bad checks.  He said it was “No big deal”.  However, as we looked into it further we learned the extent of who he was.  My mother kept the newspaper article that came out in the Orange County Register on these charges and also went to the court to obtain all the court papers, which included two psychological evaluations on Martin.  My mother stated at the time, “I want to get these (referring to the court records) and keep them, because I just feel we may need these some day.”  Who would of known that over 30 years later they would prove to be so important and we would be handing them over to the Utah County Attorney’s Office providing them with valuable information.  (These are the papers I also took to the Utah County Sheriffs, Pleasant Grove Police, and the Governors office immediately following Michele’s death).  These are also the very papers shown on 20/20 which I provided, thank-you, mom.

Things were strained for awhile between Michele and her family.  My mother tried to discuss the information in the court reports and evaluations with Michele.  What she read caused extreme concern and worry, but there was no talking to her.  They were married now complicating things even more.  We have no idea how or what he said to explain everything to her, but we just know whatever we said made her draw further from us and closer to him.  There was no talking to her.  He had a hold on her.  There was nothing we could do.

It was from that point on that we just had to move forward to keep a relationship with Michele.  We as Michele’s family tried our hardest to accept Martin. What else could we do?  We had to deal with the devil, as we saw him, or lose what we had left of a relationship with Michele.

Death of Michele:
We as Michele’s family had to find out about our own sister’s  death through a family friend in California who called my sister Terry to offer their sympathy regarding the passing of Michele.  They of course assumed we had all been notified.  My sister Terry had no idea what they were talking about and questioned if it was even true or if the person had heard just a rumor.  In a panic hearing this news Terry then called me since I live in Utah near Michele to ask me if I had heard anything.  I told her I had not and then we were both frantic and in a state of shock.  After hearing this and wondering if this could this be true,  my daughter Jill called Michele’s cell phone and Michele’s daughter, Alexis, answered and confirmed it was true, Michele had died.  I later learned that Martin forbade his family from calling Michele’s sisters or her own Mother.  I had to go over and tell my mother.  My mother then called to talk to Martin and he hung up on her.  He told Michele’s children he did not want “those people”, referring to Michele’s family, showing up at the funeral.  I received a call also with instructions of who could and couldn’t go to my sister’s funeral, because it may upset Martin and if they did show up, we were told that there would be police to escort them out of the church.  Rather than upset the girls and cause problems we decided to hold  a private graveside ceremony the following day for those of Michele’s family who were not “allowed” at the services.  We later learned that he said to someone that one good thing about Michele dying is that he wouldn’t have to “deal with us anymore.”

As soon as I heard Michele died  I had no doubt that Martin had killed her.  My whole family felt the same way and verbally expressed this.

I don’t think Martin ever wanted much to do with Michele’s family, because he could tell we could see through him.  It was even more apparent after my sister’s passing, because we knew his past and what he was really capable of.

This began my quest for justice of which you can read of further in my blog entitled,  “How did Martin get caught with Identity theft and thus discovered?  The true story and much more.”

Ending thoughts-

Over 30 years ago, my now 90 year old mother, so carefully inspired kept and watched over the 1977 court documents, which included the psychological evaluations, a copy of a newspaper article, and the imprint of an official seal from St. Martin’s College found in the trunk of her car and also stated “I won’t be surprised if he killed her some day.”  Who would of thought I would have to go to her house in April 2007 and inform her that her insight and inspiration of 30 years ago about her daughter–a mother’s worst nightmare– had come true-Michele truly had been murdered.  She even knew and tried to warn her dear Michele, but in this case evil prevailed.  What a tragedy.

I want to make it known to you how very difficult it has been for Michele’s sisters, brothers, and mother as well.  It is a different kind of pain and struggle that we have lived with.  I can’t and won’t go into descriptions or details as that isn’t what  I want to focus on.   I want to end simply by saying that Michele’s family lived all these years knowing Martin was evil and capable of anything and everything, but no body would listen and thought we were crazy.  We always questioned things among ourselves, but could go no place with the questions.  A families personal torment.. We always felt he was getting money illegally from the beginning, but like I said, where do you go with your questions?  Everyone around us seem to accept him and he got jobs everywhere etc… We would even discuss the very things he is charged with and accused of now. We also knew his schooling didn’t add up. Nothing seemed right with Martin MacNeill from the minute we knew him.  I guess I find it strange that he could fool so many people, but quite honestly he didn’t fool us ever.

We only want justice for Michele now.  To finally end the evil that we saw began in 1977.  Too bad it ended with the tragedy of  someone who we dearly love, and someone so full of beauty and potential.  The memories however cannot be taken and will forever live on with us until we see her again.

Stop Martin Stop Evil

I found these quotes on the subject of evil and evil people.  It made me ponder and I thought to myself, how true.  I love the insight of these brilliant men in our history.  I do know however that fear, intimidation, control and other things paralyze people at times making it so they “don’t do anything about it”  or others for whatever reason,  just “accept” it.  I have been guilty of this as well.  It could be because the person has threatened you or you may feel ashamed or scared.  Whatever the reason may be, fear, guilt, shame, etc…I believe the agony continues inside you because of this evil which is not a very happy peaceful way to live.  It needs to be stopped.  If you have any information or know something I urge you to come forth.  If for nothing else for your own peace of mind.  You can remain anonymous  if you wish.  I want you to know that sometimes  something small that you may think is nothing leads to a piece of a bigger puzzle.  Anything is appreciated.  Please respond to this blog if you know something.  We need to stop evil.  We need to break the silence.  It is hard to be brave, but in the long run it will set you free.

Are you a Victim from Utah State Developmental Center?

Martin MacNeill was the former director of the Utah State Developmental Center.  He had the opportunity to abuse so many for years at this facility.  I believe Martin did so.  I believe there are victims out there that have not come forward.  He also had access not only to victims, but to medication.  His stage there made his abilities to harm others limitless.  If you were a victim in anyway or know of someone who was please speak up by responding to this blog.  I am trying to find as much information out on behalf on my sister Michele and others as well who may have fallen prey to Martin MacNeill-Linda.

How did Martin get caught with identity theft and thus discovered? The true story and much more.

The events that led up to Martin being caught for identity theft creating the foundation for the more horrifying parts to surface, is an interestingly coincidental story.  Basically, one of the MacNeill’s adopted children, Giselle MacNeill, was deported by Martin back to Ukraine after Michele died.  She was under the assumption it was just for a summer visit.  However, Giselle did not return after the summer.  A brief summary of what occurs next are as follows.  When Michele’s sister, Linda and her daughter, Jill discovered this they felt compelled to do something about it.  Jill, Giselle’s cousin, began searching for her and upon reviewing the online obituary for Michele, hoping to find a contact in the Ukraine, she discovered an entry written from a “Yulia” who had posted a comment with her email address on the obituary. Yulia, was the translator from the Ukraine who helped Martin and Michele adopt their children.  Jill emailed her and asked if she might know where Giselle was.  Jill eventually received a response back from Yulia informing Jill that she did know of Giselle’s whereabouts and she soon was able to provide a phone number for Jill. Jill and Giselle eventually spoke.  Giselle was so happy to hear from Jill.  She was crying and could not wait to return to the United Stated.  She told the story of how she was left there and had no money or food.  Travel plans were arranged by our family and Jill flew to the Ukraine.  Jill could not believe the horrible conditions that she was living in and escorted Giselle home to Spanish Fork to live with Linda, Michele’s sister, and her family.  Almost one year later Giselle was finally home in the United States.

Upon Giselle’s return to the United States she was very fearful of Martin.  Michele’s sister Linda feared him as well as she knew there was some premeditated plan for Martin to have abandoned her over there.  On May 22, 2008 Linda went to court and filed and an Ex-Parte Protective Order against Martin.

Linda then had to retain an attorney to obtain guardianship.  This I find odd to have to fight for custody against a father who abandoned his daughter in a foreign country who at their own cost they had to bring back?  They have to hire an attorney at their own cost?  What’s wrong with this!?
August 11, 2008 Martin relinquished his parental rights and Custody and guardianship of Ada, Sabrina, and Elle continued with Alexis and Giselle with Linda.  (Ok, put me through months of court and the expense of attorney fees and then relinquish parental rights–typical Martin).

Linda then began the process to adopt Giselle.  It was during Giselle’s adoption process to Michele’s sister, Linda Cluff, that a curious thing came out of the wood-work.  It was discovered that  Giselle MacNeill’s ‘Date of Birth’ had been changed by 20 years!  The adoption process could not continue, and we learned that Martin MacNeill perpetrated fraud to a court, again.  More events are unfolded and are found in Linda Cluff’s record below.

Going to the Police:
Within about a week of Michele’s death I went to the police, because I suspected foul play.  This was following my sister’s funeral which Martin’s odd behavior at even greater confirmed what I already knew when I heard of her death that Martin had killed her.  I went with my daughter Jill first to the Utah County Sheriff’s with my suspicions.  We spoke to two officers there whose names I do have, but I will not publish.  I took with me the carefully kept papers from my mother from his 1977 fraud incident in Orange County which contained two psychological evaluations with alarming statements.   I also stated that I felt because he had a medical background he would know just what to do to hide any foul play which was very concerning to me.  They said unfortunately it was out of their jurisdiction so they would be unable to handle it.  They looked in the computer and told me the name Officer with the Pleasant Grove Police Department who was handling it and stated that they would pass the paperwork to that Officer and have him contact me.  I stressed that I wanted to remain confidential and not have my name on any paperwork.
First Meeting with the Pleasant Grove Police Officer:
I met briefly with him.  He informed me that he was investigating Michele’s death; and had received the documents and information from the Utah County Sheriff’s Department.  He told me some other information, but I am at this time electing not to disclose.  I was concerned with what I was told. He stated that he was awaiting autopsy results, and would let me know when he received them.  I stressed to him as well that I wished for my name to be confidential.
Second Meeting with Officer:
The Officer called me in and gave me the autopsy results.  He told me Michele’s death was ruled as natural.  He gave me more detailed information which is on the report, but I am electing to leave that out of this summary.  I informed him that the results didn’t shock me at all.  I was expecting the results to be normal.  Martin would know how to hide any sort of foul play. I absolutely knew the report would not reveal any foul play.  The Officer said he was closing the case which upset me.  All he had done was arrive at the scene, question no one except Martin about what had happened.  He then just waited for the autopsy results and closed the case.  What kind of investigation is that?  Didn’t question the neighbors or Ada even when there was discrepancies as to how she was found and the evidence cleaned up!  He also had me in there asking for an investigation with real concerns.  And what about the papers I had brought in?
Third Meeting with Officer June 21, 2007:
Two family members of Michele’s came with me to speak to the investigating officer with me.  The Officer’s supervisor came in as well.  It seemed before we even got started they had a defensive attitude.  We could sense it as we walked in the room.  We started by stating that we had very strong feelings that Martin had something to do with our sister’s death.  He of course already knew this as I had been in there previously myself stating this, but now there were three of us.  We informed them that we had just found out some new things from our sister’s children and we felt they should be made aware of this information.  (We had now learned that Michele’s children also felt their Dad killed Michele.  Prior to that they had not confided to us even though Alexis thought it all along, because she was afraid and still living with her dad trying to get her sisters that were still at home).  We told the Officer about how just a week or so after Michele was buried  Martin posed a woman named Gypsy as a nanny he had hired.  However, he had been making calls to Gypsy prior to Michele’s death.  We also told him that Michele had confided to Alexis just prior to her death stating to her that if anything happened to her to make sure that Martin had nothing to do with it.  The Officer’s only comment back was that Alexis had just probably said that because she was mad at her dad for having an affair.
The Officer was very defensive the entire time and he said, “Are you trying to tell me that I don’t know how to do my job?’”  We were all very nice to him and said, “No we have just learned new information that we thought you should be aware of.”  We also brought up the fact that if new things are discovered about the case we had heard of cases where after learning of new information they have exhumed bodies for more testing.  He and his supervisor said they had never heard of such a thing.  They made us feel like idiots.
I want to stress they were very rude.  They made us feel like we were wasting their time and putting them out.  They never asked one single question.  They took no notes.  They told us the case was closed that that was that.  When we left the station we kept saying to each other what a strange and awful experience we had felt.  They were not interested in anything we had to say at all and acted in a most unprofessional and insensitive manner.
Errors on the Police Report:
In the Narrative on the Police Report there are many error just showing how sloppy and unprofessional they were.  It states that “Michele” brought in documentation regarding Martin instead of “Linda”.  They mixed me up with my deceased sister.
They state I brought in “military records” when it was “psychology reports.”
They stated that “Linda’s” death was natural instead of “Michele’s.”
They stated that I (Linda) was shocked by the autopsy result and believed that Martin was involved, which is true.  I do believe Martin was involved, but I stated that I was NOT shocked by the autopsy results, and comments actually that it did not surprise me at all because Martin would know how to hide or cover up what he had done.  I was upset due to them stating the case was closed due to the autopsy no matter what other evidence or motive was being presented to them.  I never said Martin paid the Medical Examiner for the autopsy results.  The paper keeps quoting this incorrectly.  Also they put my name everywhere on the police report when I asked them not to.
I got no place with the Pleasant Grove Police Department.  I was told the case was closed and nothing more would be done.  I absolutely would not give up on this and began contacting the Utah County Attorney’s Office first calling, emailing, writing letters and dropping information by to Dave Sturgill.  I even wrote former Gov. Jon Huntsman Jr. and my daughter Jill hand delivered the letter in a packet with other information to the capital to his office informing them it was urgent, and made a couple of follow up calls to his secretary, Gloria.  The Utah County Attorney’s Office finally picked up the case in January 2008, after my persistence.  It was first assigned to Sgt. Toby O’Bryant, but in the beginning of March 2008 he resigned so I received an email from Jeff Robinson on March 13, 2008 explaining that he would be reassigning the case.  At that point nothing had even been done on the case.  I finally heard again from Jeff Robinson on July 14, 2008 stating that he had assigned the case to Doug Witney and that he would be reviewing my case on July 21st or 22nd.  Thus started where we are at now.

May there be justice for Michele.  For Michele’s family it has been over 30 years of struggles as we have seen and experienced things that only we know.  Martin through his lies to distance Michele from her family so in many ways we were robbed of Michele long ago.  He is never changed.  He is deceitful and cunning and always feels he is above the law.  He has deceived my sister as many others.  Martin is calculated, controlling and manipulative.  I know he is responsible for the death of my sister.  I plead for her cause.

First Impressions of Martin MacNeill

I am often asked by people, “What were your first impressions of Martin?”  I thought he was arrogant.  He walked in our house for the first time like he owned the place.  He was self-absorbed.  It became more and more apparent each time I saw him that he believed he was more superior than anyone else and he thought very highly of himself.  It became obvious how he used intimidation to get what he wanted from people.  He was also a master at manipulation.  He would skillfully and unfairly manage to influence people’s feelings and use them as a tool for his evil purposes.  People mean nothing to him except to use.  The only person who matters to Martin is Martin and that is the only person he is ever thinking about, ever worried about, or ever feels sorry for.  He puts on a show to make it appear different, but do not be deceived that is for appearance only.  There is something else on the agenda.  A tragic end for my sister.  Her life was one that the “master” managed and we could stand back and see all unfold, but could not talk reason to the deception that was skillfully placed there first.  Linda

Martin MacNeill:

I have read many comments and reference to the book “People of the lie” by M. Scott Peck in regards to Martin.  I myself have not read the book although I am going to pick up a copy now.  The title alone interests me.

In the book the author apparently states a couple of things that are so much “Martin” I wanted to post them:

1. a favorite “hiding place” of evil people is church because it reinforces their “appearance” of propriety by being associated with those who are authentically striving to live righteous lives and who truly are decent people.
2. Evil people place the highest emphasis on their “appearance” of being perceived by others as decent, honorable, safe, caring and kind all the while planning evil deeds.

I can tell you personally that is true of Martin from 33 years of watching “the play”.  Martin choose the cast.  Martin was the director.  Appearance meant everything.  Perfection was demanded.  The church was the stage and he was the actor however, behind the curtain lived a monster.

He Killed My Sister

April 11, 2007, Michele was gone!  What!   Is this true?  Calling around to confirm that yes, Michele was gone!  A sick feeling sunk deep down inside confirming an inner feeling, and without hesitation I knew “He killed my sister.”     I can’t stress enough to please come forward if you have any information at all on Martin MacNeill.  Thank you,  Linda Somers Cluff.

Martin MacNeill-Rufus Roy MacNeill

Is there anyone out there who knows where Rufus Roy MacNeill is buried? He is the brother of Martin MacNeill.  I am also looking for the exact date he died and where he died?  I have his date of birth as 12/31/44. Is there anyone at all?  Please help.  Thank-you, Linda

Martin MacNeill steals from the Veterans Administration & Social Security Administration

Did you know that Martin MacNeill was given a military leave after allegedly being deemed a schizophrenic.  He was given 50 percent disability from the Veterans Administration and then 100 percent based on him being anti-social, not going to school, and claiming he wasn’t working.  He also managed to get 100 percent pay from Social Security, while still earning a six-digit income.

Does anyone with these organizations ever check anything out or do they just write checks?  Martin was working the entire time as a physician earning a income and at the same time still claiming the disability.  He was collecting thousands of dollars each month between both of these organizations for over 30 years as if he was not working and never getting caught?  He had a separate bank account unknown to his family.

Martin can steal from the true disabled vets and from the social security administration, but gets no additional time in prison for that?  I’m serious! I can only imagine how the veterans who are truly disabled and so deserving will feel knowing this.  What is wrong with this system?  I hear of people all the time who steal no where near this kind of money on the news and get time, but why should stealing millions of dollars from these organizations matter? Does that make sense?

He needs to pay for these crimes!  We lives in a crazy world!  I will keep on fighting for justice, because my sister is worth it and so is all the innocent people who have been hurt by Martin

Martin MacNeill who is now serving time in prison worked as the medical director at the Utah State Developmental Center.  He has called himself an MD at times and a DO at times.  He also has his JD from BYU, but he falsified transcripts from college to get into medical school and into the BYU law school.  He was even on probation from his felony conviction in Orange County when he attended medical school.  How does that happen?  This man was caring for the disabled at the developmental center?  How scary is that?  Did they not do a background check? How did he get jobs caring for people with a felony conviction in his past? How did he get into law school with a prior felony on his record?  Did he perhaps lie on his application?  Will there be a repercussion for that?    His entire life has been made of lies and more lies to cover those lies.

Martin MacNeill-Blanding Clinic-Utah 1988

Martin MacNeill lived with my older sister and her family in Blanding, Utah in 1988 for a short time and worked at the Blanding clinic and in the emergency room at the hospital.  Are there any victims of Martin MacNeill in Blanding?  Is it possible some crime against someone could have occurred there?  I believe there are victims in every path he has crossed.  If you are a victim of Martin MacNeill or know of someone who was, please contact me.  I want to know of anyone else who may have fallen victim to his evil.

Does anyone in Blanding or Monticello Utah know about a big town meeting that was held regarding Martin? The meeting was apparently held at the Elementary School cafeteria regarding Martin’s medical credentials that supposedly had somehow been lost or something like that, and the meeting was packed with people. One thing the people wanted was proof that he was indeed a doctor.  Did anyone out there attend this meeting or know about it?
